PC Check In (a.k.a. “the software”) and accompanying documentation is licensed and not sold. This software is protected by copyright laws and treaties related to other forms of intellectual property. Check In Systems Inc or its subsidiaries, affiliates or suppliers, (collectively “Check In Systems”) own intellectual property rights in the software. The licensees (“you” or “your”) license to download, use, copy or change the software is subject to these rights and all terms and conditions of this End User License Agreement (“agreement”).
YOU ACCEPT AND AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT BY INSTALLING, USING OR COPYING THE SOFTWARE. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, YOU MUST NOT INSTALL, USE OR COPY THE SOFTWARE.
Upon installation, Check In Systems provides a 30 day trial license valid for the first 30 days of use. Upon payment, Check In Systems Inc. will provide a license key with an expiration date to provide full use of the software upon one computer or one virtual computer. Check In Systems Inc grants license and all rights to use the software and any updates available during which period the license key is valid.
The end user may use the software only for its own computing needs and those of its subsidiaries and corporate affiliates.
The end user may not:
- (i) sell, lease, license, distribute or sublicense the software or documentation
- (ii) decompile, disassemble, or reverse engineer any part of the software
- (iii) allow access to the software by others not licensed under this agreement
- (iv) share copies of the software or documentation with with others not licensed under this agreement
- (v) make so much of the functionality of the software available to others as software-as-a-service that the service competes with the software for customers
- (vi) assist or allow others to use the software against the terms of this agreement
Check In Systems Inc. does not guarantee the software to be compatible with any other software or operating system and therefore the software may require to be installed on a limited or specific computer configuration to fully work.
Check In Systems Inc will, at times, update the software and make it available for download to the end user. Updates are not mandatory and are not automatically applied. It is the responsibility of the end user to evaluate the need for any update and apply if necessary or wanted. Prior to applying any update, the end user shall properly back up any and all data so as to reduce risk of loss. Check In Systems Inc assumes no responsibility for the loss or damage to data.
Third Party Software and Updates
While Check In Systems continually strives to improve the software and makes every effort to be compatible with standard operating systems and other software, Check In Systems makes no warranty as to compatibility with other software or operating systems.
Following the optional 30 day trial, the end user must make payment in full, prior to use of the software, to receive a license key. This payment is non-refundable, regardless of expiration period.
Ownership and Proprietary Rights
Check In Systems Inc and its suppliers retain all title, ownership, and intellectual property rights in the Software, including but not limited to all supporting documentation, files, marketing material, images, multimedia, and applets. The Software is protected by copyright and other intellectual property laws and by international treaties. The Software may include security measures designed to control access and prevent unauthorized copying and use. You agree not to interfere with any such security components. Check In Systems Inc permits you to download, install, use, or otherwise benefit from the functionality or intellectual property of the Software only in accordance with the terms of this EULA.
The End User retains all title, ownership, and intellectual property rights to the data created by the software.
Privacy & Security
The general structure of the software is solely intended for internal network use only and not to be used across internet connections. The software does not use encrypted protocols and therefore should never have direct access to the internet.
The data should be secured behind firewalls by the end user and backed up by the end user using standard backup methods. Check In Systems Inc assumes no responsibility for the security or integrity of the data created by the software.
Disclaimer and Limits
THE SOFWTARE IS PROVIDED “AS-IS,” “AS AVAILABLE,” AND ALL
WARRANTIES, EXPRESS OR IMPLIED, ARE DISCLAIMED (INCLUDING BUT NOT LIMITED TO THE
DISCLAIMER OF ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR
PURPOSE). THE INFORMATION AND SERVICES MAY CONTAIN BUGS, ERRORS, PROBLEMS OR OTHER
LIMITATIONS. WE AND OUR AFFILIATED PARTIES HAVE NO LIABILITY WHATSOEVER FOR YOUR USE OF
ANY INFORMATION OR SERVICE. IN PARTICULAR, BUT NOT AS A LIMITATION THEREOF, WE AND OUR
AFFILIATED PARTIES ARE NOT LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL
DAMAGES (INCLUDING DAMAGES FOR LOSS OF BUSINESS, LOSS OF PROFITS, LITIGATION, OR THE
LIKE), WHETHER BASED ON BREACH OF CONTRACT, BREACH OF WARRANTY, TORT (INCLUDING
NEGLIGENCE), PRODUCT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH
DAMAGES. THE NEGATION OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE
BASIS OF THE BARGAIN BETWEEN US AND YOU. THIS SITE AND THE INFORMATION WOULD NOT BE
PROVIDED WITHOUT SUCH LIMITATIONS. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN,
OBTAINED BY YOU FROM US THROUGH THE SITE SHALL CREATE ANY WARRANTY, REPRESENTATION OR
GUARANTEE NOT EXPRESSLY STATED IN THIS AGREEMENT.
ALL RESPONSIBILITY OR LIABILITY FOR ANY DAMAGES CAUSED BY VIRUSES CONTAINED WITHIN THE
ELECTRONIC FILE CONTAINING THE FORM OR DOCUMENT IS DISCLAIMED. WE WILL NOT BE LIABLE TO
YOU FOR ANY INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND THAT MAY RESULT
FROM USE OF OR INABILITY TO USE OUR SITE. OUR MAXIMUM LIABILITY TO YOU UNDER ALL
